1. Enrolment and Participation:
   a. The Student must be at least 18 years old or have written consent from a legal guardian to participate in the kitesurfing and/or wingfoil lessons provided by Surf with Talis.
   b. The Student acknowledges that kitesurfing and/or wingfoil lessons involve physical activity and assumes all risks associated with participating in such activities.
   c. The Student must provide accurate and complete information during the enrolment process, including any medical conditions or physical limitations that may affect their ability to participate safely during the lessons.

2. Lesson Bookings and Payments:
   a. Lesson bookings are subject to availability and can be made through the Surf with Talis' designated booking channels.
   b. The Student agrees to pay the specified fees for the lessons as determined by Surf with Talis.
   c. Payments can be made in the form of cash, or bank transfer.
   d. Surf with Talis reserves the right to modify lesson prices and payment terms, provided that the Student has been informed in advance.

3. Cancellations and Refunds*:
   At Surf with Talis, we strive to provide excellent kiteboarding and/or wingfoil lessons and customer service. However, we understand that sometimes unforeseen circumstances can arise that may require cancellation or refund of lessons.
   
   a. Cancellations by the Student:

   • If the Student wishes to cancel a lesson, they must provide notice to Surf with Talis as early as possible.

   • Refunds for cancellations will be subject to the Surf with Talis's refund policy, which may include applicable fees or deductions.

   • If you notify us within 72 hours from purchase, we will process a cash refund, with no cancellation/admin fee charged.
     
     Based on receipt of the cancellation notice the cancellation fees are calculated as follows:

    

   • up to 30th day before arrival 20 %

   • from the 29th until 22nd day before arrival 30 %

   • from 21st until 15th. day before arrival 50 %

   • from 14th until 3rd day before arrival 75 %

   • from 1st day before arrival and no show 100 %

   • No refunds or credits will be given for any unused portion of a lesson/rentals. (conditions apply)
     
     Cancellation is still possible at any time, please contact us via e-mail or phone to inquire.
     
     b. Cancellations by Surf with Talis:

    

   • In the event that Surf with Talis needs to cancel a lesson due to weather conditions or other unforeseen circumstances, the Student will be offered the option to reschedule the lesson or receive a refund for the canceled lesson.

   • Surf with Talis will not be responsible for any additional costs incurred by the Student due to lesson cancellations 
     
     c. No-shows:

   • If the Student fails to attend a scheduled lesson without prior notice, no refunds or rescheduling options will be provided.
     
     d. Cancellations with 3rd party organisers:

   • Please be advised that event organisers and tour operators may have their own conditions & cancellation policies. If you have booked through a 3rd party, please refer to them.
     
     e. Other:

   • All discounts, promo and special books are final and cannot be exchanged or refunded.

   • In special cases, other cancellations fees may apply. This will be informed accordingly before booking.

   • In certain cases where cash refund is not possible after payment, a voucher (valid for 2 years) will be issued for the value of any unused courses, rental or storage.
     
     **Please note: Refunds can take up to 2 weeks to process. We cannot be held liable for any delay or additional charges on the part of your banking institution.
     
     Surf with Talis cannot be held liable for any incorrect bookings or reservations.

4. Rental Equipment: In the event of any damages to the equipment, the following rates shall apply for repair or replacement. For damages related to kites, wings, boards, foils which also include torn material, kite/wing torn in half, burst bladder/struts, and lost kite/wing/board, the applicable rates are as follows:
   
   Kite and Wing:

   • Torn Material: €100

   • Kite Torn in Half: €400

   • Burst Bladder/Struts: €100

   • Lost Kite: €1,000
     
     Bars:

   • Broken Lines: €150

   • Lost Bar: €350
     
     Foils:

   • Broken Wing/stab: €400/200

   • Lost Foil: €1,000
     
     Boards:

   • Broken Fins: €100

   • Broken Fin Box: €100

   • Up to 10cm Cracks: €100

   • Creased or Cracked in Half: €700

   • Lost Board: €700

   • Lost Wingfoil board: €1500
      

    

5. Safety and Conduct:
   a. The Student must comply with all safety instructions provided by Surf with Talis's instructors.
   b. The Student is responsible for using all safety equipment provided by Surf with Talis during lessons.
   c. The Student must behave responsibly and respect Surf with Talis's instructors, staff, and other students.
   d. Surf with Talis reserves the right to dismiss any Student from lessons for inappropriate behaviour or actions that may endanger themselves or others, without refund.

6. Liability and Insurance:
   a. The Student acknowledges that kitesurfing involves inherent risks and accepts full responsibility for any injuries or damages incurred during or as a result of the lessons.
   b. The Student is strongly advised to have personal insurance coverage that includes kitesurfing activities.
   c. Surf with Talis will not be liable for any loss, injury, or damage to personal property during the lessons.

7. Intellectual Property:
   a. The Student agrees not to reproduce, distribute, or use any intellectual property owned by Surf with Talis, including but not limited to logos, images, or instructional materials, without prior written consent.

8. Governing Law and Jurisdiction:
   a. This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Surf with Talis is located.
   b. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
    

By participating in kitesurfing and/or wingfoil lessons provided by Surf with Talis, the Student acknowledges that they have read, understood, and agreed to abide by these Terms and Conditions.
